Terms & Conditions

This document contains the “Terms and Conditions”, which shall be applicable to all transactions initiated by the User through the AZ eWallet Application. The User is advised to carefully read and understand these Terms and Conditions before using the AZ eWallet Application. By using AZ eWallet Application, the User will be deemed to have read, understood and confirms his/her acceptance of the Terms and Conditions, mentioned here. The user will be bounded by these terms and conditions, as amended from time to time. The terms and conditions shall be displayed on AZ eWallet website and AZ eWallet Application and shall continue to apply each time the User uses the App.

DEFINITIONS

App/Application: The Software installed at the user’s smartphone.

Bank: The financial institution that has the customer’s account and issuing payment instruments to be utilized in payments through the App.

Dispute: Any contentious matters reported by the customer related to a financial transaction.

AZ eWallet: The Website or The Mobile payment software installed at the user’s smartphone used for the purpose of payments to merchants and transfers.

Merchant: The entity/person that receives the payment in exchange of assets/services by the AZ eWallet

Payment Instrument: The tool used for payments issued by the bank i.e. Debit Card, Credit Card, bank account.

Transaction: The processcarried out betweena buyer and a seller to exchangean asset for payment or fund transferbetween payer and beneficiary.

User: The person who uses the AZ eWallet Application.

SCOPE OF AZ eWallet APP

AZ eWallet Services offers an instant, twenty four hours i.e. 24X7, interbank electronic Payments and Money transfer services to the Users.

To access the AZ eWallet Services, Users are required to download on their mobile, the AZ ewallet App which is the mobile application for facilitating payments or use the AZ eWallet Website.

The AZ eWallet App may only be used by account holders or customers of those Banks offering AZ eWallet Services. Authorization to the User to use the AZ eWallet App is subject to the fulfilment of all the terms and conditions laid down by the User’s Account HoldingBank, including the submission of the necessary documents and information requiredby the Bank from time to time.At all times, User shall be liable for any transaction donethrough AZ eWalletApp and shallindemnify Central Bank of Kuwait and Ministry of Commerce for all loss/damage caused by any unauthorized use of AZ eWallet App.

Transfer of Money via AZ eWalletApp is subject to the restrictions like maximum amount or maximum daily or periodic limitsthat may be imposed by the AZ eWallet App or the Remitting bankfrom time to time, at its solediscretion.

To use AZ eWalletapp, the User must completethe registration formalities, in such form, manner and substance as may be prescribed by Central Bank of Kuwait and Ministry of Commerce, and Central Bank of Kuwaitand Ministry of Commerce shall beentitled, at its sole discretion, to accept or reject suchapplications.

Central Bank of Kuwait and Ministry of Commerce reserves the right to modify the scope of the AZ eWallet App at any time.

TERMS

User shall guarantee that all the personal information provided at the registration in the AZ eWallet application is correct, valid, and no misrepresentation has been made by the User.

Entering otherpersons information shallhold the userliable and subjectto criminal prosecution.

The Payment instrument registration/enrollment in the AZ eWallet is subject to verification and authorization by the card issuer bank using the authentication tool provided to the cardholder (i.e. PIN, 3D secure,Secure Code).

User shallnot share any passwords, PINcodes, IDs relatedto payment authorization or login to AZ eWallet account,any such disclosure shall be at the absoluteliability of the Userwho shall be liable for any lossessustained as a result of such disclosure or by any act of negligence. All transactions initiated by the userfrom any payment instrument registered in the wallet is the liability of the user.

The use of the App is personal to the User;the User may not assignit to anyone else. User agrees and acknowledges, at his/her full risk and liability, that he/she is the personal holder of the Account(s) and consequently the primary holder of the debit/credit card(s) whose credentials may be necessary for payments using the App.

User authorizes AZ eWallet to store personal information provided at the registration, certain data of the payment instruments and transaction history and information.

The User shall not hold AZ eWallet responsible for any dispute/issue arising from any purchase of goods/Services from Merchant(s) through transactions initiated via AZ eWallet Application or fund transfer to any beneficiary. User understands and agrees that all such claims, if any shall be against such Merchant(s) or beneficiary and not against AZ eWallet, which shall be initiated by contacting the User’s respective Bank.

AZ eWallet will not share any sensitive data with any third party.

Any use of the App with the purpose of payment or transfer using Banks payment instruments to debit/credit account is subject to Banks verification, authorization, and acceptance.

User shall take all necessary measuresto keep the debit/credit card(s)and Personal Identification Number(PIN code) relatedto it, and assumes all responsibility for any and all consequences of not keeping the PIN code confidential, as well as for any unauthorized useof the Appby any otherperson.

For transfers/payments using accounts, the User authorizes his/her Bank to debit his/her account based on a request initiated by the User through the AZ wallet for the purposeof payment or transfer.

REFUND AND CANCELLATION POLICY

Amount once paid through the payment gateway shall not be refunded other than in the following circumstances:

If you changed your mind on a purchase or made a mistake you can cancel the payment or ask your seller or merchant for a refund.

Multiple times debiting of Customer’s Card/Bank Account due to technical error OR Customer's account being debited with excess amount in a single transaction due to technical error.In such cases, excess amount excluding PaymentGateway charges would be refunded to the Customer.

Due to technical error, payment being charged on the Customer’s Card/Bank Account while the enrollment for the examination is unsuccessful. The customer would be provided with the enrollment at no extra cost. However, if in such cases, the Customer wishes to seek a refund of the amount, he/she would be refunded net the amount, after deduction of payment gateway charges or any other charges.

The Customer will have to submit an application for refund along with the transaction number and original payment receipt,if any generated, at the time of making payments. The application in the prescribed format should be sent to customercare@az- ewallet.com

The application will be processed manually, and after verification, if the claim is found valid, the amount received in excess will be refunded by our accounts department through electronic mode in favor of the applicant and confirmation will be sent to the mailing address given in the online registration form, within a period of 20 calendar days on receipt of such claim. It will take 5-20 days for the money to show in your bank account depending on your bank’s policy.

PRIVACY POLICY

Our privacy policy is subject to change at any time without prior notice. You are advised to always review the policies for any changes prior to using the App.

When you use our Application, we collect and store your personal information provided by you from time to time. We do so to ensure that you are provided a safe, efficient, smooth, and seamless experience. This also allows us to understand your needs and provide for services and features that best suit them. Also, the collection of such information is to provide for customizations on our application and to ensure that your experience is always safer and easier.

If you choose to transact on the App, we will collect information about your transaction behavior. We collect some additional information, such as details of the recipient or payer of the transaction, location, etc. which may be used for providing a better experience to you while using the App, along with marketing and statistical purposes.

We use personal information to provide the services you request. We may use this information to keep you informed of any online and offline offers, products, services, and such updates shall be made available for use.

We may use the information obtained in order to detect, protect, and prevent error, fraud, and other criminal activity and to enforce our terms and conditions which are conditions precedent to use the App.

GOVERNING LAW

The present Terms and Conditions and its amendments from time to time shall be governed by the laws of State of Kuwait and subject exclusively jurisdiction of the Kuwait Courts.
