This document contains the “Terms and Conditions” applicable to all transactions initiated by the User through the AZ eWallet Application. Users are advised to carefully read and understand these Terms and Conditions before using the AZ eWallet Application. By using the AZ eWallet Application, the User will be deemed to have read, understood, and accepted the Terms and Conditions mentioned here. The User will be bound by these terms and conditions, as amended from time to time. These terms and conditions shall be displayed on the AZ eWallet website and AZ eWallet Application and shall continue to apply each time the User uses the App.
DEFINITIONS
App/Application: The software installed on the user’s smartphone.
Bank: The financial institution that has the customer’s account and issues payment instruments used in payments through the App.
Dispute: Any contentious matter reported by the customer related to a financial transaction.
AZ eWallet: The website or mobile payment software installed on the user’s smartphone used for payments to merchants and transfers.
Merchant: The entity/person that receives the payment in exchange for assets/services via the AZ eWallet.
Payment Instrument: The tool used for payments issued by the bank, such as a debit card, credit card, or bank account.
Transaction: The process carried out between a buyer and a seller to exchange an asset for payment or fund transfer between a payer and beneficiary.
User: The person who uses the AZ eWallet Application.
SCOPE OF AZ eWallet APP
AZ eWallet Services offer instant, 24/7, interbank electronic payments and money transfer services to Users.
To access AZ eWallet Services, Users must download the AZ eWallet App on their mobile devices or use the AZ eWallet Website.
The AZ eWallet App may only be used by account holders or customers of banks offering AZ eWallet Services. Authorization to use the AZ eWallet App is subject to fulfilling all terms and conditions laid down by the User’s Account Holding Bank, including submitting necessary documents and information required by the Bank from time to time. The User is liable for any transactions done through the AZ eWallet App and shall indemnify the Central Bank of Kuwait and Ministry of Commerce for all loss/damage caused by any unauthorized use of the AZ eWallet App.
Money transfers via the AZ eWallet App are subject to restrictions such as maximum amount or daily/periodic limits imposed by the AZ eWallet App or the remitting bank at their sole discretion.
To use the AZ eWallet App, the User must complete the registration formalities as prescribed by the Central Bank of Kuwait and Ministry of Commerce
The Central Bank of Kuwait and Ministry of Commerce reserve the right to modify the scope of the AZ eWallet App at any time.
TERMS
- The User shall guarantee that all personal information provided during registration in the AZ eWallet application is correct, valid, and not misrepresented.
- Entering another person’s information will hold the user liable and subject to criminal prosecution.
- Payment instrument registration/enrollment in the AZ eWallet is subject to verification and authorization by the card issuer bank using authentication tools provided to the cardholder (e.g., PIN, 3D secure, Secure Code).
- The User shall not share any passwords, PIN codes, or IDs related to payment authorization or login to the AZ eWallet account. Any such disclosure shall be the absolute liability of the User, who shall be liable for any losses sustained as a result of such disclosure or any act of negligence.
- All transactions initiated by the User from any payment instrument registered in the wallet are the User’s liability.
- The use of the App is personal to the User; the User may not assign it to anyone else. The User agrees and acknowledges, at their full risk and liability, that they are the personal holder of the account(s) and consequently the primary holder of the debit/credit card(s) whose credentials may be necessary for payments using the App.
- The User authorizes AZ eWallet to store personal information provided during registration, certain data of the payment instruments, and transaction history and information.
- The User shall not hold AZ eWallet responsible for any dispute/issue arising from any purchase of goods/services from Merchant(s) through transactions initiated via the AZ eWallet Application or fund transfer to any beneficiary. All such claims, if any, shall be against such Merchant(s) or beneficiary and not against AZ eWallet, which shall be initiated by contacting the User’s respective Bank.
- AZ eWallet will not share any sensitive data with any third party.
- Any use of the App for payment or transfer using banks' payment instruments to debit/credit accounts is subject to banks' verification, authorization, and acceptance.
- The User shall take all necessary measures to keep the debit/credit card(s) and Personal Identification Number (PIN code) confidential and assumes all responsibility for any consequences of not keeping the PIN code confidential, as well as for any unauthorized use of the App by any other person.
- For transfers/payments using accounts, the User authorizes their Bank to debit their account based on a request initiated by the User through the AZ eWallet for payment or transfer.
USER RESPONSIBILITIES
The customer acknowledges and agrees that they alone bear full responsibility for the truth and accuracy of the information and instructions, including payment instructions provided through the AZ eWallet application.
The Customer authorizes AZ eWallet to act in accordance with instructions received from the Customer in connection with the Service at the Customer's risk. Furthermore, the Customer agrees to indemnify AZ eWallet for all actual losses that it may incur as a result of such instructions.
AZ eWallet has the right to refuse to implement any instructions provided by the customer without giving any justification, for example, if the transactions are not in compliance with applicable laws, legitimate transactions, anti-money laundering instructions, Central Bank of Kuwait instructions, etc., applicable in the State of Kuwait. AZ eWallet does not bear any responsibility if any instructions from the customer are not implemented due to technical problems.
AZ eWallet may, at its absolute discretion, amend or change any of the terms and conditions, including transfer limits, at any time without the need to obtain customer approval. These new terms and conditions will become effective 7 days after the customer receives notification from AZ eWallet of the aforementioned amendments. The customer must accept amendments to the terms and conditions to continue using the services provided by AZ eWallet.
Financial transfers include transfers between personal accounts, transfers to other accounts in the bank, transfers between local banks, and external transfers.
Transfers made during business hours and before 11:30 PM will be processed on the same day. Transactions made after official business hours or during weekends and public holidays will be executed on the next business day, except for transfers between personal accounts or other accounts at AZ eWallet, which will be executed on the same day.
The Customer agrees and undertakes to maintain the confidentiality of the username and credentials for the electronic services “AZ eWallet Application” issued by AZ eWallet or created by the Customer.
The customer agrees that they alone bear full responsibility for any actual loss or damage resulting from the misuse of the personal number of the ATM card or any other card and the PIN created by the customer themselves or any other user, whether authorized or not. Accordingly, AZ eWallet will not be responsible for any unauthorized or fraudulent attempt to use the personal number and PIN of the ATM card or any other card.
The customer acknowledges and agrees that once they accept the terms and conditions of electronic banking services when accessing the AZ eWallet application to obtain the banking service, they are deemed to have reviewed, read, and agreed to the terms and conditions of the services or requested transaction. The customer also agrees to abide by and act in accordance with the terms and conditions.
AZ eWallet may terminate this Agreement at any time by notifying the Customer in the manner it deems appropriate without giving any reasons for termination and without incurring any obligations as a result of such termination.
REFUND AND CANCELLATION POLICY
Amount once paid through the payment gateway shall not be refunded other than in the following circumstances:
If you changed your mind on a purchase or made a mistake, you can cancel the payment or ask your seller or merchant for a refund.
Multiple times debiting of Customer’s Card/Bank Account due to technical error OR Customer's account being debited with excess amount in a single transaction due to technical error. In such cases, excess amount excluding Payment Gateway charges would be refunded to the Customer.
Due to technical error, payment being charged on the Customer’s Card/Bank Account while the enrollment for the examination is unsuccessful. The customer would be provided with the enrollment at no extra cost. However, if in such cases, the Customer wishes to seek a refund of the amount, he/she would be refunded net the amount, after deduction of payment gateway charges or any other charges.
The Customer will have to submit an application for refund along with the transaction number and original payment receipt, if any generated, at the time of making payments. The application in the prescribed format should be sent to customercare@az-ewallet.com.
The application will be processed manually, and after verification, if the claim is found valid, the amount received in excess will be refunded by our accounts department through electronic mode in favor of the applicant and confirmation sent to the mailing address given in the online registration, within a period of 21 calendar days on receipt of such claim.

DISPUTE RESOLUTION POLICY
Any disputes arising in connection with this agreement shall be resolved through negotiations. If the parties are unable to resolve the disputes amicably within 30 days, the disputes shall be referred to arbitration. The arbitration shall be conducted in Kuwait in accordance with the laws of Kuwait. The decision of the arbitrator shall be final and binding on the parties.
GOVERNING LAW AND JURISDICTION
This agreement shall be governed by and construed in accordance with the laws of Kuwait. Any disputes or legal proceedings arising out of or relating to this agreement shall be subject to the jurisdiction of the courts of Kuwait.
AMENDMENTS
AZ eWallet reserves the right to amend these terms and conditions at any time. Such amendments shall be effective immediately upon posting on the AZ eWallet website or application. The continued use of the AZ eWallet services after any such changes shall constitute the User's consent to such changes.
By using the AZ eWallet Application, the User acknowledges that they have read, understood, and agreed to these Terms and Conditions.
